אחריות בין לאומית

מוצרי החברות סמסונייט (Samsonite) ואמריקן טוריסטר (American Tourister) מזוודות ותיקים נבדקים בקפדנות ועומדים בתקנים מחמירים ביותר.
תקופת האחריות מפורטת בכתב-האחריות שבמוצר. האחריות -האחריות חלה רק על הרוכש הראשון או מקבל המתנה של המוצר.
האחריות מכסה אך ורק פגמי ייצור. במקרה של פגם בייצור) על פי שיקול דעת מרכז השירות, (יתוקן המוצר או יוחלף על פי שיקול-דעת מרכז השירות ובהתאם לתנאי האחריות. במידה והפגם ו/או התקלה עומדים בתנאי האחריות, יעודכן הלקוח אם המוצר יתוקן או יוחלף. אם יש להחליף את המוצר, אך הוא אינו זמין עוד, יוחלף המוצר למוצר שווה ערך למוצר המקורי – ע"פ הערך ששולם בעבורו במקור. למרכז השירות שמורה הזכות לשנות מפרט טכני זה או אחר לפי ראות עיניה; האחריות מוגבלת לערך המוצר כפי ששולם במעמד הרכישה. האחריות אינה חלה על – כל נזק אשר יגרם על ידי צד שלישי. רכיבים וחיבורים חשמליים ואלקטרוניים, כבלים, מתאמים וסוללות. כמו כן, האחריות אינה מכסה כל נזק שנגרם למוצר משימוש בלתי סביר, טיפול לא הולם, תאונות, שחיקה, חשיפה לטמפרטורות קיצוניות, ממיסים, חומצות, מים, בלאי רגיל או נזקים שנגרמו במהלך הובלה כגון שברים. כמו-כן אין האחריות מכסה נזקים קוסמטיים כגון שריטות, שקעים, כתמים, שינויי צבע או שינויים אחרים במראה המוצר, אשר אינם פוגמים כלל בשימוש במוצר לייעודו. לקבלת שירות בתקופת האחריות במרכז השירות, יש להציג תעודת-אחריות מלאה וחתומה כהלכה, ובכללה שם החנות ומועד הרכישה, או לחילופין – חשבונית מס-קבלה מקורית של הרכישה המעידה על דגם המוצר ומועד רכישתו.

נזקים בהובלה –
עם קבלת המוצר, לאחר ההובלה/לאחר טיסה עם חברת תעופה/לאחר שנגע בו כל אדם אחר מלבדכם – יש לבדקו אם נפגע במהלך הובלתו. אם אכן נפגע/ניזוק/נשבר – יש להגיש תלונה לחברת ההובלה/ התעופה) אשר מבוטחת בעבור מקרי גרימת נזק למוצרים הללו, (במקום שאליו הגיע המוצר ובמידת האפשר עוד לפני מעבר המכס.
חשוב לציין – מנעולי המוצר, אם ישנם, נועדו אך ורק למניעת פתיחה בשוגג, ואינם יכולים בהכרח למנוע גניבה של המוצר או תכולתו, למנוע שבירה או פתיחה על ידי אנשי חברות תעופה ו/או הובלה, או נמלי תעופה או רשויות ממשלתיות. כאמור, יש לבדוק המוצר מיד לאחר טיפול/הובלה על ידי מישהו אחר מלבדך.
להלן פרטי מרכז השירות המאושר בישראל, ע"י היבואנית הרשמית והבלעדית בישראל – קבוצת רולטיים בע"מ, הן לעניין המכירה עצמה והן לעניין האחריות והשירות:
כללי –
תנאי אחריות זו נועדו להעניק לך זכויות משפטיות ספציפיות. בנוסף לזכויות המתוארות במסמך זה, ייתכן שיש לך גם זכויות אחרות המשתנות ממדינה למדינה ביחס להחרגה או יישום של אחריות משתמעת, נזקים מקריים ותוצאתיים, תיקון והחלפה. ומכיוון שכך, ייתכן שההגבלות או ההחרגות הכלולים באחריות זו לא יחולו עליך.
מסמך זה, בשפה העברית, נועד להקל עליך ולהבהיר מה כוללת תעודת האחריות. אין בהסבר זה כדי להחליף ו/או לגרוע מאי-אילו מההוראות הרשומות בכתב-האחריות, ובכל מקרה, נועד כדי להוסיף על תעודת- האחריות, והינו כפוף לה ולכל התנאים הרשומים בה. אין באמור בכתב-אחריות זה משום לפגוע בכל זכות או סעד לו הנך זכאי בהתאם להוראות חוקי הגנת הצרכן ותקנותיהם במדינת ישראל.
אנו מקווים שתיהנו מהמוצר שנרכש, ומהשירות שתקבלו בזכות כתב-אחריות בינלאומי זה, התקף לתקופה המצוינת בתעודת-אחריות המוצר.

בעוד שתחזוקה ו/או תיקונים ללא אחריות יכולים להתבצע על ידי כל גורם, הרי שתיקונים החוסים תחת האחריות, חייבים להתבצע אך ורק במרכז שירות מאושר) להלן "מרכז שירות. רחוב אימבר 23, קריית אריה, פתח תיקווה.

SAMSONITE GUARANTEE

Samsonite products are rigorously tested to ensure that the travel products you trust meet stringent standards. Consequently, if a problem occurs with this Samsonite product (the “Product”) and the problem is caused by manufacturing defects in material and workmanship, Samsonite will, in its discretion, either fix or replace the Product in accordance with the warranty terms and conditions stated herein. The warranty provided for herein applies only to the first purchaser or gift recipient of the Product. The duration of the warranty and the designation of the goods to which it applies are stated on the warranty documentation inside the Product and/or in the list of Product features on our website.
Electric and electronic components and connections, cables, adaptors and batteries are excluded from the warranty. The warranties described herein cover only manufacturing defects and do not cover any damage caused by misuse or unreasonable use, improper care, accidents, abrasion, exposure to extreme temperatures, solvents, acids, water, normal wear and tear or improper carrier handling (by airlines for example); cosmetic damage like scratches, dents, stains, color changes or other non-functional changes in the appearance of the Product are also excluded. If your Product is damaged in transit, submit a claim to the transit company at the place of arrival, if possible, before clearing customs.
While non-warranty maintenance or repairs on your Product can be performed by any company, Samsonite requires that you use only an approved Samsonite service center (“Service Center”) for warranty repairs. Improper or incorrectly performed maintenance or repairs avoid this warranty. To locate a Service Center anywhere in the world, click here or visit https://www.supportandgo.com/ServiceInfo/ServicePointLocation. Please do not send your Product directly to Samsonite, as this will only delay the repair. This warranty is global, and you may have your Product repaired at any Service Center in the world. You are, however, responsible for all costs of getting the Product to any such Service Center including, but not limited to, the cost of packaging, shipping, and applicable taxes.
For warranty service at a Service Center, you will need the duly completed warranty certificate or original receipt of purchase. The Service Center will determine whether the problem is covered by Samsonite’s warranty. If the warranty applies, you will be notified as to whether the Product will be repaired or replaced. Any such repair or replacement will be at Samsonite’s expense, including any costs required to return the repaired or replacement product to you. If the Product is to be replaced and the Product is no longer available, Samsonite will substitute a product similar in value.
Incidental and consequential damages are expressly claimed. Labor charges and damages attributable to work performed by anyone other than a Service Center are not covered by this warranty. To the extent permitted by applicable law, any implied warranties are hereby excluded. The warranty provided herein is limited to the value of the Product. Manufacturing specifications are subject to change without notice. Product locks are intended only to prevent accidental opening and cannot necessarily prevent theft of the Product or its contents, breakage or entry by airline or airport personnel or governmental authorities. Inspect your Product immediately after handling it by anyone other than you.
Our warranty is intended to give you specific legal rights. In addition to the rights described herein, you may also have other rights that vary from state to state or country to country with respect to the exclusion or application of implied warranties, incidental and consequential damages and repair and replacement. Consequently, the limitations or exclusions specifically contained in this warranty may not be applicable to you. In the European Union you are entitled by law to remedies from the seller free of charge in the event of a lack of conformity of the Product and those remedies are not affected by this commercial guarantee.
